Terms and
conditions.

The terms on which StudyNote Tuition provides tutoring. Plain language, because terms nobody reads protect nobody.

1. Who these terms are between

These terms are between StudyNote Tuition (ABN 57 880 380 382) and the parent, guardian or adult student who books a session. Booking a session means accepting these terms.

Where the student is under 18, a parent or guardian must make the booking and is responsible for payment.

2. What we provide

Tutoring in the subjects listed on this site, for Years 7 to 12, delivered in your home, at a public library, or online. Sessions are one-to-one or in small groups, capped at six students in SACE years and eight in Years 7 to 10.

Tutoring supports a student’s learning. It does not guarantee a mark, a grade, an ATAR, or any other outcome, and nothing on this site should be read as promising one.

3. Bookings

Sessions are booked one at a time or as a recurring weekly slot. There is no minimum term, no contract period, and no joining fee.

We may decline or end a booking where we cannot properly support the student, where a subject is outside what we can teach, or where clause 7 applies. If that happens we will tell you why, and we will try to point you towards someone who can help. If we end a booking, you are invoiced only for sessions that have already happened, and anything paid beyond that is refunded in full.

4. Fees and payment

Rates are published on the fees page and are payable per session. The first conversation is free and nothing is payable until after it.

Payment is due within seven days of the session unless agreed otherwise. Rates may change with at least 30 days’ notice. A change never applies to a session that is already booked.

5. Cancellation and rescheduling

You may cancel or reschedule any session with at least 24 hours’ notice at no charge. Inside 24 hours we will first try to move the session to another time in the same week. Where we cannot, 50% of the session fee is charged. Where nobody is present at the agreed time and place and we have had no notice, the full session fee is charged.

Those amounts are our genuine estimate of what a late cancellation costs us: an hour held and no longer fillable at short notice, and in the second case a trip made for nothing. They are not a penalty, and they are set below the full value of the hour in the first case because a cancellation we could not move still saves us some preparation and, for a session in your home, the drive. Sessions are invoiced after they happen, so a late fee is never taken automatically. We will tell you before it appears on an invoice, and you can raise it with us first.

If we cancel a session for any reason, we reschedule it to suit you or we do not charge for it. If the student is unwell, or we are, no late fee applies. Tell us and we will work it out.

6. Sessions in your home

Where a session runs in your home, a parent or another responsible adult must be home for the whole session, and the session runs in an open part of the home, not a bedroom. It is a simple safeguarding rule, and it protects both your kid and the teacher. How we keep every session safe is set out on our child safety page.

A quiet space with a table, a chair and good light is all we need. If a session cannot go ahead safely or usefully when we arrive, we will talk it through with you, and the session is charged as a late cancellation under clause 5.

7. Conduct

We expect ordinary courtesy in both directions. We may end a session immediately, and decline further bookings, if a student or another person present behaves in a way that is abusive, threatening, or unsafe. Sessions ended on this basis are charged in full.

8. Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, and where a term would do so, it does not apply.

If something goes wrong with a session, the Australian Consumer Law sets out the remedies you are entitled to, and how they work depends on how serious the problem is. Those remedies apply in full and we do not limit them. For any liability that falls outside those guarantees, we limit ours only as far as the law allows.

We are not liable for a student’s academic results. Results depend on the student’s own work, their school, and matters outside our control.

9. Your information

We collect only what is needed to answer your enquiry and run the sessions. We do not sell it and we do not pass it to other tutors, agencies or advertisers. A small number of named service providers handle it on our behalf, such as the form relay that delivers your enquiry. Who they are, how long anything is kept and how to have it deleted are all set out in the privacy policy.

You can ask us what we hold, ask us to correct it, or ask us to delete it at any time by emailing hello@studynote.com.au.

10. Materials

Practice materials and notes we provide are for the student’s own use. They are not to be resold or distributed. Work the student produces is entirely their own.

11. Changes to these terms

We may update these terms. The version that applies to a session is the one published when it was booked. Material changes are notified by email to anyone with a session booked.

12. Governing law

These terms are governed by the law of South Australia, and the courts of South Australia have jurisdiction over any dispute under them.

13. Questions

If anything here is unclear, just ask. Get in touch and you will get a straight answer.
